These Terms of Service ("Terms") govern your purchase and use of the software and digital products offered by the Company through its online store. By purchasing, downloading, activating, or using any such product, you agree to these Terms.

The Software and Licenses

The Software is licensed, not sold. The Company offers different products and license types. For each product, the license type (for example one-time / lifetime, or a subscription where offered), the price, the supported operating systems or platforms, and the number of devices on which a License may be activated are shown on that product's page and at checkout, and are confirmed in your order. Those product-specific terms form part of these Terms for the product you purchase.

Subject to payment and these Terms, the Company grants you a non-exclusive, non-sublicensable, non-transferable license to install and use the purchased Software for your own purposes. Where a License is sold per operating system or platform, it entitles only the operating system(s)/platform(s) it was purchased for. Each License may be activated on a limited number of devices as stated for that product; you may release a device to free an activation slot and transfer the License to another machine, within the stated limit.

Where a License is described as "lifetime", it does not expire and is not a subscription; it covers the product line current at the time of purchase, including maintenance updates made generally available for it, and does not guarantee future paid major versions. Where a product is offered as a subscription, access continues for as long as the subscription is paid and active.

Payments, Pricing and Taxes

Purchases are processed by Creem as merchant of record. Prices are shown on the product page and at checkout, may differ between products, and may include applicable taxes determined by Creem based on your location. By completing a purchase you also agree to Creem's terms applicable to the transaction. Your order confirmation, receipt and License Key are delivered by email.

Digital Delivery and Right of Withdrawal

The Software is digital content delivered electronically (download and/or License Key) immediately after purchase. If you are a consumer in the European Union, you normally have a 14-day right of withdrawal for distance contracts. By purchasing and activating the Software you expressly request immediate performance and acknowledge that, once delivery has begun (for example the License Key has been issued or the download started), you lose the right of withdrawal for that digital content, to the extent permitted by applicable law.

Refunds

Refunds are handled by Creem as merchant of record in accordance with its refund policy and applicable consumer law. If a product does not work as described, or you experience a problem, contact us first at [email protected] and we will help resolve it or assist with a refund request. Your statutory consumer rights are not affected by these Terms.

Acceptable Use

You agree to use the Software lawfully and not to: (a) resell, rent, sublicense or redistribute the Software or License Keys; (b) circumvent license activation or device limits; (c) reverse engineer, decompile or disassemble the Software except to the extent expressly permitted by mandatory law; or (d) use the Software to infringe the rights of others or to access systems without authorization.

Updates

The Company may provide updates, fixes and improvements for the Software. A product may check for and install updates automatically; where an in-app updater is unavailable (for example store-distributed builds), updates are delivered through the respective store.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Software is provided "as is" and "as available" without warranties of any kind, whether express or implied. The Company does not warrant that the Software will be uninterrupted, error-free, or compatible with every system configuration. Nothing in these Terms excludes or limits rights that cannot be excluded or limited under mandatory consumer law.

Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special or consequential damages, or loss of data or profits, arising out of or related to your use of or inability to use the Software. Where liability cannot be excluded, it is limited to the amount you paid for the License concerned. This limitation does not affect mandatory consumer rights.

Governing Law

These Terms are governed by the laws of Poland, without prejudice to the mandatory consumer-protection rules of the country in which you reside. Disputes shall be subject to the competent courts, save for any mandatory consumer jurisdiction rules that apply to you.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest revision. Changes do not apply retroactively to licenses already purchased to the extent that would reduce your rights.
